The engine holds this as the one real, verified piece surviving a broader (rejected) 'they're locking up the commons' theory — a genuine but partial takeover of commercial seed genetics.
How it works
Four firms (Bayer/Monsanto, Corteva, Syngenta, BASF) control about 95% of US corn seed IP and 84% of soybean, roughly 90% of trait acres, and about 70% of germplasm; enforcement includes the 9-0 Bowman v. Monsanto ruling (2013) and 144 suits against 410 farmers recovering about $423.5M. BUT that only binds patented seed — saving heirloom and open-pollinated seed is still legal, the Open Source Seed Initiative keeps 375+ varieties free, and 'Terminator' sterile-seed tech was never commercialized under a UN moratorium.
Why it matters
It's a case where the engine holds both sides at once: commercial seed is genuinely enclosed and enforced, yet a legal open path for old-style seeds still survives under pressure — no single villain named.
